DUI and DMV

DUI and DMV

If you are arrested for a DUI, the DMV will take action against you along with the court. The DMV has the authority to suspend your license, and will likely do so if they find you guilty of driving under the influence. Our office has dealt with DMV proceedings for over 500+ DUIs and we are experts on helping our clients retain their right to drive!

DMV Hearing

After being arrested for DUI, you have 10 days to notify the DMV and request an “admin per se hearing.” This hearing will determine whether or not you receive DMV consequences, and is your opportunity to have a defense against DMV disciplinary action. Our office will handle all DMV related events on your behalf, and we have had great success preventing license suspension and defending our clients. Call 530-580-8529 if you are looking for an attorney to help you navigate the DUI DMV process!

Refusals

A refusal occurs when an individual is stopped for a DUI and refuses to provide law enforcement with a blood test or chemical breath test. If it is decided that a driver did commit a refusal, there is a mandatory one year license suspension. There are many valid defenses to a refusal including officer misconduct and improper procedure. If you are being accused of a refusal, call our office at 530-580-8529. Attorney Susan Hearne has helped to defend against accusations of refusal and has successfully advocated for the dismissal of this charge on behalf of many clients.

Interlock Ignition Device (IID)

If the DMV sides against you and determines you did in fact commit a DUI offense, your license will be suspended. If you wish to continue to drive, you may install an Interlock Ignition Device in order to retain your driving privilege. To obtain an IID, you must provide proof of enrollment in a DUI education course and SR22 insurance. We can help you navigate this process and ensure you obtain an IID that meets all regulations and allows you to legally drive anywhere you would like. We have working relationships with IID providers, that make this process more streamlined. If you choose our office to represent you, we will provide you with a smooth and effective process to get an IID.

Testimonials

THANK YOU THANK YOU THANK YOU. Little did I know at my first weekend at Chico state that I would encounter such a crap time with the zero tolerance cops. Long story short. Having a good time I was written and fined a ticket for minor in possession of alcohol. Not knowing much I went to court plead not guilty. I ended up realizing I needed help. I looked online read the BEST reviews and met 30 minutes before my hearing and had her do her thing and a month later I walked away with what I was ok with and still had my license. Which was a huge thing. Thank you nor cal law.
